§ 1 Scope
The general terms and conditions apply to all contractual relationships between the Cambridge Institut GmbH and its customers. By signing the registration form/submitting the online registration form, the customer acknowledges the validity of the general business relationships. Contradictory or deviating terms and conditions of the customer are not recognized by the Cambridge Institut GmbH. No oral collateral agreements have been made. Changes or additions to the agreement require written form. The written form requirement cannot be waived.
§ 2 Conclusion of Contract
- Registration for individual language training takes place in writing via our online shop or the registration form by e-mail or directly at reception.
- The contract becomes effective upon confirmation of the enrolment by the Cambridge Institut.
- Registration is binding and implies acceptance of these conditions of participation.
- The validity period of the lessons is two years from the date of booking. After this period, all remaining lessons expire.
§ 3 Terms of Payment
- Payment can be made directly via the online shop or by paying the amount into the account specified below. It is also possible to pay by cash/EC-card at our front desk. The costs for individual language training must be paid at the latest before the first training date.
- Payment in instalments must be agreed in advance and requires our written consent.
- In the event of late payment, we reserve the right to refuse participation in the language training course.
§ 4 Termination and Cancellation
- Cancellation must be made in writing.
- Cancellations up to 5 days before the first tuition appointment are free of charge.
- In the event of cancellation less than 5 days before the first appointment, 20% of the course fee will be charged as administrative costs.
- In the event of cancellation after the first day of the training, the full course fee must be paid.
§ 5 Cancellation of training sessions
- Individual lessons must be postponed or cancelled by 5 p.m. the day before by telephone (089 22 11 15) or email (info@cambridgeinstitut.de) at the latest. Otherwise, the full fee for this appointment will be charged. For lessons on a Monday, please send us a cancellation e-mail by Friday at 5 pm.
- If a lesson is cancelled by the Cambridge Institut after 5 pm, an alternative lesson will be offered.
§ 6 Default
- If the course fee is not paid by the due date (see fee schedule) / by the first of the respective course month in advance, the customer is in default of payment after a reminder by Cambridge Institut GmbH unless the reminder is dispensable under § 286 para. 2 BGB.
- In this case, Cambridge Institut GmbH reserves the right to prohibit participation in the course until payment is made.
- In the event of default, the customer is obligated to compensate Cambridge Institut GmbH for all default damages, regardless of any other claims.
§ 7 Applicable Law
- The contractual relationship and its implementation are subject exclusively to the law of the Federal Republic of Germany, insofar as this does not deprive the customer of the protection granted to him by those provisions from which, under the law that would apply in the absence of a choice of law in accordance with Sentence 1, deviation by agreement is not permissible.
- If the customer is a merchant, a legal entity under public law, or a special fund under public law, or if the customer does not have a general place of jurisdiction in the Federal Republic of Germany, Munich is agreed as the place of jurisdiction for all disputes arising from this contract. Otherwise, the statutory place of jurisdiction applies.
- Should individual provisions of these conditions be or become invalid or void, this shall not affect the validity of the remaining provisions.
