Terms and Conditions for Ongoing Courses

1. Scope

The general terms and conditions apply to all contractual relationships between the Cambridge Institut and its customers. By signing the registration form, the customer acknowledges the validity of the general business relationships. Contradictory or deviating terms and conditions of the customer are not recognized by the Cambridge Institut. No oral collateral agreements have been made. Changes or additions to the agreement require written form. The written form requirement cannot be waived.

2. Conclusion of Contract

The contract is concluded at the agreed conditions by signing the registration form. The registration is binding. The minimum participation period for an ongoing course is one calendar month and is extended by one calendar month until the timely termination on the 20th of the previous month (see point 7).

3. Course Fee

3.1. The course fee is to be paid in full in advance for each calendar month without being requested. Payment must be made by the 1st of each month, or a declaration of assumption of costs from the employer must be submitted by this time. The course fee is only valid for the respective due month and is not transferable to another period.

3.2. Payment is made by depositing the amount into one of the accounts listed below. There is also the option of granting a direct debit authorization using the attached form or payment in cash/EC card at the registration.

3.3. The amount of the course fees can be found in the valid fee schedule and refers to one calendar month, regardless of the number of course days. No fee is charged for the month of August.

3.4. The customer cannot claim compensation (make-up classes), in particular, a refund of the course fee for unused lessons.

3.5. The course fee is not transferable to other persons/participants.

4. Advance Payment

4.1. A discount of 5% or 10% is granted on the total invoice amount for advance payment of 3 or 6 course months, respectively.

4.2. A discount can only be given for the originally selected course.

4.3. There is no refund of the (partial) course fee for services not used.

4.4. In individual cases, a break in participation or a change to another course can be agreed upon after consultation. A rebooking fee of €40.00 is due for this.

5. Change of Course

A change of course is generally possible free of charge depending on capacity and can be requested for the following calendar month (exception: see point 4.4).

6. Amendment/Non-Performance

The Cambridge Institut reserves the right to cancel a course, change the time conditions and content of the course, or offer the participants another course if the minimum number of participants for the booked course is not reached.

7.Termination and Cancellation

7.1. The customer can terminate the contract each month until the 20th of the month for the following month. The cancellation period also expires on Sundays and public holidays because cancellation online is possible on these days. The statutory regulations of § 193 of the German Civil Code do not apply.

7.2. If the contract is not terminated in due time, it will be extended by another calendar month.

7.3. Cancellation of the contract is possible before the start of the course and on the first day of the course in the contract period. The registration will be canceled free of charge.

7.4. The termination or withdrawal must be made in writing.

7.5. If the participant is not satisfied after the first day of the course during the contract term, the registration can be canceled in writing within 2 days without giving reasons. In this case, 100% of the course fee will be refunded to the participant.

7.6. In case of a late withdrawal, the full course fee for the respective calendar month must be paid.

8. Default

8.1. If the course fee is not paid by the 1st of the respective course month in advance, the customer is in default without a reminder from the Cambridge Institut.

8.2. In this case, the Cambridge Institut reserves the right to prohibit participation in the course until payment is made.

8.3. In case of default, the customer must reimburse all default damages, such as reminder fees of €10.00 per reminder, and default interest, regardless of other claims.

9. Applicable Law

9.1. The law of the Federal Republic of Germany exclusively applies to the contractual relationship and its execution.

9.2. If the customer is a merchant, a legal entity under public law, or a special fund under public law, or if the customer does not have a general place of jurisdiction in the Federal Republic of Germany, Munich is agreed as the place of jurisdiction for all disputes arising from this contractual relationship. Otherwise, the statutory place of jurisdiction applies. If individual provisions of these terms and conditions are ineffective or void, this does not affect the effectiveness of the remaining provisions.
